If you choose to purchase Focus Tower Premium (unlocking features like Auto-Routines), we require you to authenticate using Sign in with Google (OAuth). By authenticating, you grant us access to your primary Google email address.

• Purpose: Your email address is used solely to securely verify, manage, and restore your Premium license across your devices.
• Protection: We do not access your contacts, Google Drive, or any other Google account data. Your email is kept strictly confidential and is never sold, rented, or used for marketing purposes.

4. Security & Third-Party Platforms

While we use commercially acceptable means to protect your email address (for Premium users), no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security and assume no liability for unauthorized access or data breaches beyond our immediate control. Furthermore, payments and downloads are handled by third-party platforms (e.g., Google Play); their collection of your payment data is governed by their respective privacy policies.

5. International Users

Focus Tower operates from India but serves a global audience. Any minimal data we process (such as a Premium user's email) is subject to the laws of India. By using the App, you consent to the processing and standard handling of this data as described in this policy, regardless of your country of residence.

2. App Functionality & Extreme User Responsibility

Focus Tower is a strict productivity tool designed to forcefully block applications on your device based on parameters you set. You acknowledge and agree that:

• You are solely responsible for selecting which apps to allow or block.
• We hold zero liability for any missed communications, ignored alarms, failed notifications, missed deadlines, or inability to access emergency services resulting from your use of the App.
• To function, the App requires critical device permissions, notably the AccessibilityService API. You are responsible for granting and managing these permissions.

3. Premium Features & Accounts

Certain features are available as a Premium upgrade. To access Premium features, you must authenticate using Google Sign-In (OAuth). You agree that your Google email address will be used to manage and verify your one-time purchase or active license. All purchases are handled via standard App Store platforms and are subject to their respective terms. All sales are final and non-refundable unless required by applicable law.

THE APP IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, FICTIONAL STREAM EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, BUG-FREE, SECURE, OR COMPLETELY EFFECTIVE AT BLOCKING ALL DISTRACTIONS ON EVERY OS VERSION OR DEVICE MODEL.

IN NO EVENT SHALL FICTIONAL STREAM, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES. THIS INCLUDES, BUT IS NOT LIMITED TO, LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR INJURY/DAMAGES ARISING FROM MISSED EMERGENCY CALLS, NOTIFICATIONS, OR ALARMS CAUSED BY THE APP'S BLOCKING FEATURES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US FOR THE APP DURING THE SIX (6) MONTHS PRIOR TO ANY CAUSE OF ACTION ARISING.

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) your use of the App; (2) your breach of these Terms; or (3) your violation of the rights of a third party.

7. Governing Law and Jurisdiction

These Terms and your use of the App are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal action or proceeding related to the App shall be brought exclusively in the competent courts located in India, and you hereby consent to the personal jurisdiction and venue of such courts.
